A while back I did a post on the relative merits of work for hire vs. getting an advance on royalties in publishing contracts. If you're unclear on these terms check out the link.
After being a Gadling travel blogger for more than a year I've discovered another advantage of work for hire--when you sign away your rights you don't have to defend them. Gadling, or more precisely AOL Media, pays me a flat fee and then owns total rights to my posts. I agree to this because their flat fee is good and they have the most popular travel blog on the web. Once my posts go live, they are their property.
What a relief! With so many people stealing stuff from online sources I'd spend half my day tracking down copyright violations. For example, one blogger reused a photo of mine without permission, others have taken articles, and the Somaliland Times, a weekly English newspaper, reprinted my entire Somaliland travel series. Actually I don't mind that last one, because how many people in Hargeisa read Gadling?
So I can sit back and watch the plundering of my work with a serene detachment. Sure it's wrong, but it gets me more readers, and if AOL Media's lawyers want to do something about it, that's their job. I hope they don't go after the Somalis, though. The Somali people showed me so much hospitality they deserve to get my articles for free.

Plagiarist Beats A Hasty Retreat
In a previous post, I talked about how some idiot on LiveJournal uploaded the latest issue of Newbie Writers onto his blog, thereby breaching copyright with the editor, me, and all the other contributors. Newbie Writers Dawn Copeman and I made complaints to LiveJournal, but Idiot either realized the error of his ways or someone clued him in to copyright law, because the post was taken down before they could take action.
I have to say I'm a bit disappointed. I wanted to get his account terminated. This guy claims to be a writer, but thinks nothing of using another writer's work without compensation. Well, I'm willing to bet that's one "Newbie Writer" who'll never make it into the Midlists, or anywhere else!

Getting Plagiarized
On my other blog, Grizzled Old Traveler, I talked about plagiarism at the White House press office, and wondered if I've ever been plagiarized. Well, not two hours after posting that entry I found out that I have! Some idiot on LiveJournal cut and pasted the entire July issue of Newbie Writers onto his blog.
What an idiot. Just because something is freely available on the internet doesn't mean you can copy it. The newsletter isn't even on the webpage, but only available through a free subscription, so he's obviously a subscriber. Well, a certain "newbie writer" needs to educate himself before he gets sued. Not only did he violate the copyright of the newsletter editor, but he violated my copyright and that of all the other contributors. Both the editor and I have filed abuse reports to LiveJournal.
Interestingly enough, I can't provide you a link to Idiot's post because that would be aiding and abetting a breach of copyright, and therefore would open me up to getting sued too. Plus I wouldn't want to subject you to his insipid prose and atrocious poem about erectile dysfunction. No, I'm not making that last bit up. I really, truly wish I was, but I'm not.
